Terms governing your use of dis-inc.com and engagement with Dynamic Isolation Systems.

Effective date: January 1, 2025

1. Acceptance of terms

These Terms and Conditions ("Terms") govern your use of dis-inc.com (the "Site") and any interaction with Dynamic Isolation Systems, Inc. ("DIS," "we," "our," or "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

2. About DIS and our products

Dynamic Isolation Systems is a manufacturer of seismic isolation products, including lead rubber bearings, sliding isolators, viscous wall dampers, low-mass isolation systems, and floor isolation systems. We provide engineering consultation, design support, manufacturing, and testing.

Product information on this Site is descriptive. Specifications, capacities, and engineering parameters for any particular project are confirmed in our written quotation, shop drawings, and test reports for that project. The Site is not a substitute for project-specific engineering review.

3. Quotes, orders, and contracts

Information submitted through forms on this Site does not, by itself, create a contract. Binding commercial terms exist only when DIS issues a written quotation that you accept in writing, or when a separate purchase order is acknowledged by DIS in writing.

All sales are subject to DIS's then-current Standard Terms and Conditions of Sale, which control over any conflicting terms in a purchaser's documents unless we expressly agree otherwise in writing.

4. Engineering information and "as-is" disclaimers

Drawings, calculations, modeling parameters, and other engineering content on the Site are provided for general reference and education. They are not a substitute for project-specific engineering by a licensed professional familiar with the site, the structure, the governing codes, and the applicable ground motion.

DIS makes no warranty, express or implied, that the general information on the Site is suitable for any particular project. The structural engineer of record for the project is responsible for the design and qualification of the isolation system in their structure.

5. Intellectual property

All content on this Site, including text, graphics, photographs, drawings, logos, the DIS brand mark, and software, is the property of Dynamic Isolation Systems or its licensors and is protected by U.S. and international copyright and trademark law.

You may view, download, and print materials from this Site for non-commercial reference purposes. Any other use, including reproduction, distribution, modification, or use in commercial materials, requires prior written permission from DIS.

6. Permitted use of the Site

You agree not to:

Use the Site in a way that violates any applicable law or regulation.

Attempt to gain unauthorized access to any portion of the Site or its underlying systems.

Interfere with the operation of the Site or burden it with automated or excessive requests.

Use the Site to send unsolicited commercial communications.

Misrepresent your identity or affiliation when contacting us.

7. Third-party links

The Site links to LinkedIn, Facebook, Instagram, and to PDF documents and third-party engineering resources. We do not control those sites and are not responsible for their content, privacy practices, or availability. Following any such link is at your own discretion.

8. Limitation of liability

To the maximum extent permitted by law, DIS, its officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including loss of profits, data, or business opportunities, even if advised of the possibility of such damages.

Our total liability arising from your use of the Site is limited to one hundred U.S. dollars (USD $100). This limitation does not apply to liability that cannot be excluded under applicable law, and it does not apply to any contract for the supply of products or engineering services, which is governed by the separate written agreement covering that project.

9. Indemnification

You agree to indemnify and hold harmless DIS and its representatives from any claim, liability, or expense arising from your misuse of the Site or violation of these Terms.

10. Export controls

Some DIS products and technical information are subject to U.S. export-control laws and regulations. You agree not to access, download, or transmit content from the Site in violation of those laws, including the Export Administration Regulations (EAR) and any applicable sanctions programs administered by OFAC.

11. Governing law and dispute resolution

These Terms are governed by the laws of the State of Nevada, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Site or these Terms will be resolved exclusively in the state or federal courts located in Washoe County, Nevada, and you consent to the personal jurisdiction of those courts.

12. Changes to these Terms

We may update these Terms from time to time. The current version is always posted here with the effective date below. Continued use of the Site after a change means you accept the updated Terms.
